ITW Linx warrants to the original purchaser that ITW Linx surge protection products will be free from defects in materials and workmanship for the lifetime of the product. Lifetime means the period between purchase and the date product sacrifices itself, including fusible elements, and electrically disconnects the line source of power or surge energy from the protected equipment.
- REMEDY: During the warranty period ITW Linx will replace, repair or refund the purchase price of defective products that are installed properly, proven to be defective, and have not been altered or repaired by anyone other than ITW Linx.
- WARRANTY LIMITATIONS: This warranty applies only to the original purchaser, and is not transferable. This warranty does not include, nor does ITW Linx assume responsibility for, defects or damage caused by misuse, abuse, alterations, or failure to use the product in a normal and proper manner. As a condition of the warranty, the purchaser must provide proof of purchase date and price. The remedy above is the exclusive remedy. ITW LINX SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Under no circumstances does the warranty cover damage to connected equipment or costs of business interruption caused by such damage.
- STATE LAWS: This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Additional Warranty Limitation for Purchasers other than Consumers
THE ABOVE WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, AND SPECIFICALLY EXCLUDES ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

ITW Linx must determine that the surge protector shows signs of surge damage or is operating outside of design specifications, relative to its surge protection capability, and under all of the circumstances failed to protect your connected equipment.

- PROPER INSTALLATION: ITW Linx AC protectors must be directly plugged into a properly grounded 3-wire AC outlet. Extension cords*, non-grounded two prong adapters, or other non-ITW Linx surge products must not be used. All wires (including, e.g., AC power lines, telephone lines, signal/data lines, coaxial cable, antenna lead-ins) leading into the protected equipment must first pass through a single ITW Linx SurgeGate, DataLinx® or RacMAX® 3400 or RacMAX® 3700 protector designed for the particular application. All goods returned to ITW Linx will become the property of ITW Linx and will not be returned. ITW Linx will send you a letter explaining the test results and notifying you of the status of your claim.
ITW Linx reserves the right to inspect the damaged connected equipment, parts, or circuit boards. Please note that you are responsible for any and all charges related to shipping the damaged equipment to ITW Linx. ITW Linx also reserves the right to inspect the customer’s facility. Damaged equipment deemed uneconomical to repair must remain available for inspection by ITW Linx until the claim is finalized.

- EXCLUSIONS: THE ITW LINX CONNECTED EQUIPMENT PROTECTION WARRANTY DOES NOT APPLY TO: Service charges, installation costs, reinstallation costs; setup cost; diagnostic charges; periodic checkups; routine maintenance; loss of use of the product; costs or expenses arising out of reprogramming or loss of programming and/or data; shipping charges or fees; service calls; loss or damage occasioned by fire, theft, flood, wind, accident, abuse or misuse, and products subject to manufacturer's recall or similar event.
- Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- DISPUTE RESOLUTION: Any controversy or claim arising out of or relating to ITW Linx’s Connected Equipment Protection Warranty, or the alleged breach thereof, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You may file for arbitration at any AAA location in the United States upon the payment of the applicable filing fee. The arbitration will be conducted before a single arbitrator, and will be limited solely to the dispute or controversy between you and ITW Linx. The arbitration shall be held in any mutually agreed upon location in person, by telephone, or online. Any decision rendered in such arbitration proceedings will be final and binding on each of the parties, and judgment may be entered thereon in a court of competent jurisdiction. The arbitrator shall not award either party special, exemplary, consequential, punitive, incidental or indirect damages, or attorney's fees. The parties will share the costs of arbitration (including the arbitrator's fees, if any) in the proportion that the final award bears to the amount of the initial claim.

About our products
Surge protectors are designed and manufactured to protect properly connected and grounded electrical equipment against spikes and surges. Once a surge protector absorbs to its capacity, it will no longer provide surge protection. ITW Linx brand surge protectors provide a lifetime warranty against product defects. See warranty for details. Surge protectors that have been damaged while protecting your connected equipment are not considered defective and therefore are not covered under warranty.

Only connected equipment is covered. Personal property damage should be discussed with your insurance carrier. |
